We filed a provisional waiver application and the same was approved. However, U.S. consulate/ embassy, Philippines denied the immigrant visa based on unlawful presence and fraud waiver (he entered the USA as Crewman initially). We filed a waiver application and the same has been approved by the USCIS.

Matter of TIMA, 26 I&N Dec. 839 (BIA 2016)
A fraud waiver under section 237(a)(1)(H) of the Immigration and Nationality Act, 8 U.S.C. § 1227(a)(1)(H) (2012), cannot waive an alien’s removability under section 237(a)(2)(A)(i) for having been convicted of a crime involving moral turpitude, even if the conviction is based on the underlying fraud.

Fraud waiver approved for Client who used fake identity documents to obtain residency in the United Kingdom and then used the same documents when he was petitioned by his U.S. citizen wife. Client can now reenter the United States and join his wife who serves in the U.S. Navy.

On 2/24/12, AILA joined immigration advocacy organizations in sending initial comments for USCIS to consider as it develops the proposed rule to implement stateside processing of provisional waivers of inadmissibility for certain aliens.

DHS agreed to terminate removal proceedings. Apparently, CIS agreed that Client’s Naturalization application was denied in error. Client’s father naturalized before she married and visas were current when she entered, therefore she was not inadmissible at the time of entry nor did she commit fraud.
