DOS Posts Visa Bulletin for February 2021

DOS posted the February 2021 Visa Bulletin. In addition to final action dates and dates for filing for family and employment-based petitions, it contains notes on the diversity visa (DV) category, DV category rank cutoffs that will apply in March, visa availability in the coming months, an annual report of immigrant visa applicants in the family-sponsored and employment-based preferences registered at the National Visa Center as of November 1, 2020, and more. USCIS determined that, for February 2021, F2A applicants may file using the Final Action Dates chart. Applicants in all other family-sponsored preference categories must use the Dates for Filing chart. Applicants in all employment-based preference categories must use the Final Action Dates chart.

Visa Bulletin and Adjustment of Status Dates for March 2019

DOS posted the Visa Bulletin for March 2019. In addition to the final action dates and dates for filing applications, the bulletin includes notes about diversity immigrant visas (DV), the Employment Fourth Preference Category for Certain Religious Workers (SR), and the Employment Fifth Preference Categories (I5 and R5). USCIS determined that for March 2019, the Dates for Filing chart must be used for family-based preference filings and the Final Action Dates chart must be used for employment-based preference filings.

USCIS Provides Historical National Average Processing Times for All USCIS Offices

In March 2018, USCIS redesigned how it displays and calculates its processing times. Recently, USCIS published the national average processing times for select forms for FY2014 through FY2018, as of January 2018. These processing times are based on the age of the workload that USCIS has awaiting adjudication (pending cases) and combines data from all the USCIS offices.

2016 Visa Bulletin

DOS released the Visa Bulletin for January 2016, including the availability of immigrant numbers for “Application Final Action Dates” and “Dates for Filing Applications.” There was forward movement in the “dates for filing” and the “final action dates” for many of the family-based categories. In addition, there was forward movement in the “final action dates” for the employment-based, second preference category for India, which advanced to February 1, 2008, and for the employment-based, third preference category for China, India, Mexico, and the Philippines. The “dates for filing” for the employment-based, third preference category for Mexico advanced to January 1, 2016.

Processing Times Released

USCIS released updated processing time reports dated November 17, 2015, with processing dates as of September 30, 2015, for the California Service Center (CSC), theNebraska Service Center (NSC), the Texas Service Center (TSC), the Vermont Service Center (VSC), the National Benefits Center (NBC), and the Immigrant Investor (EB-5) Program.

The October Visa Bulletin Fiasco

The U.S. District Court for the Western District of Washington issued an order denying the plaintiffs’ motion for a temporary restraining order (TRO) against the State Department in the class action lawsuit regarding the October 2015 Visa Bulletin. The court’s order stated, “While the Court appreciates the confusion caused by the two Visa Bulletins published in September and the potentially wasted expenses Plaintiffs incurred as a result, because Plaintiffs fail to meet the critical elements for a temporary restraining order at this time, the Court cannot issue injunctive relief.”

USCIS announced that, approximately one week after DOS releases the Visa Bulletin each month, it will post an announcement on its website to inform adjustment of status applicants whether they can rely on the “filing dates” chart or the “final action dates” chart in the Visa Bulletin to determine when they can file their applications.

Employment Based adjustment application quota met for fiscal year

USCIS advised that it has suspended final adjudication of employment-based Form I-485 applications as of today, because the Department of State indicated that the statutory cap has been reached for the employment-based preference categories through the remainder of FY2015, which concludes on September 30, 2015. USCIS stated that it will continue to accept adjustment of status applications that are filed when the applicant’s priority date is earlier than the relevant cut-off date published in the September Visa Bulletin. Final adjudication of employment-based adjustment applications will resume on October 1, 2015, on which date visa numbers will again be available.
