The U.S. District Court for the District of Maryland issued a class-wide preliminary injunction prohibiting federal immigration officials from arresting, detaining, or removing noncitizens who have final orders of removal and who are married to U.S. citizens at I-130 marriage interviews. The court also ordered ICE to release from custody all noncitizen petitioners and proposed class members, including release from orders of supervision and immigration detention.

Effective immediately, USCIS has made Form I-130, Petition for Alien Relative, available for online filing. Acting USCIS Director Cuccinelli announced that this form is now the 8th available for online filing, and is part of the agency’s push to become paperless. Petitioners can also use the online portal to track their status, pay fees, communicate with USCIS, and respond to requests for evidence. The paper version of Form I-130 will still be accepted.

Motion to reopen filed 6 years after I-130 denial approved by USCIS in Santa Ana, CA. Client can now apply for residency, through his sister’s petition, in 3 years rather than having to refile and wait 13 years
