Biden partially lifted Trump’s pandemic-related green card ban.

President Biden lifted the Trump administration’s orders preventing foreigners from moving to the U.S. on new green cards, saying the orders failed to advance American interests. Trump first enacted the ban last April, and it was set to expire March 31. However, Biden’s proclamation revoked that ban and its extensions a month early. Family members of U.S. citizens and green card holders will now be able to immigrate to the U.S., along with individuals who were selected to receive visas through the diversity visa lottery, which allows the U.S. to accept 55,000 immigrants annually from countries with historically low levels of immigration.

U.S. Citizenship Act Introduced in the House

Representative Sánchez (D-CA) introduced the U.S. Citizenship Act of 2021 in the House. Senator Bob Menendez (D-NJ) released the text of an identical bill that he is expected to introduce in the Senate next week. Both bills embody the legislative proposals presented by President Biden on his first day in office.

Biden to use ‘more inclusive’ immigration terms.

President Biden is instructing officials to use “more inclusive” language when discussing immigration. Acting Director of USCIS, Tracy Renaud, signed a memo sent in an email Tuesday informing officials to use “more inclusive language in the agency’s outreach efforts, internal documents and in overall communication with stakeholders, partners and the general public.” Specifically, the word “alien” is replaced with “noncitizen,” “illegal alien” is replaced with “undocumented non citizen” or “undocumented individual,” and “assimilation” is replaced with “integration or civic integration.” A USCIS spokesperson said the memo was signed so that the agency “aligns our language practices with the administration’s guidance on the federal government’s use of immigration terminology.”

Biden gets rid of MPP Policy

The Law Offices of Brian D. It is a great relief to immigrants and the U.S. to have a new President who is not anti-immigrant and who does not bash and scapegoat immigrants to appease a White Nationalist base. Here are a few items of significance which President Biden has signed and what it means.

President Biden Issues Executive Order Revising Civil Immigration Enforcement Policies and Priorities. ICE Acting Director issued a memo establishing interim guidance in support of the interim civil immigration enforcement and removal priorities issued by DHS on 1/20/21. The guidance, effective immediately, covers enforcement actions, custody decisions, execution of final orders of removal, and more. While there has already been a Federal Judge in Texas who enjoined this order, it basically puts a halt on deportations to address the policies and reasons behind the deportations. This is because Trump both increased deportations and removed due process from people fighting to be deported. Our Law Office represents people in removal and deportation proceedings from the very first meeting with ICE to all of the hearings in front of the Immigration Judge. This would include the Master Calendar hearing, the contested hearings, the merits hearings and trial. If needed, our deportation attorneys will appeal your case to the Board of Immigration Appeals. We can even go up to the Circuit Courts of Appeal to do the Petitions for Review.

Another set of Executive orders deals with asylum and refugees. White House Issues Executive Order on Enhancing Refugee Resettlement Programs. President Biden issued an Executive Order revoking certain past presidential actions on refugee admissions and resettlement; directing government agencies to take steps to improve URSAP. The bottom line is that Trump essentially removed and stopped refugees from coming into the U.S. Of course, the U.S. is a beacon of hope for persons being prosecuted across the world and Trump did not care. President Biden has significantly increased the amount of refugees now allowed into the U.S. Getting asylum is not easy. Our immigration attorneys will prepare the entire asylum application and get supporting evidence from experts, Amnesty International, the State Department and other sources. As you might know, Trump instituted the draconian MPP policy where people who were applying for asylum coming from the border from Mexico had to remain in Mexico until they had a Court date in the U.S. This was absurd as people suffering and being persecuted were essentially told to remain in a dangerous place of which many still missed their court dates. It was cruel. Now, President Biden has put an end to this. The White House issued an executive order to implement a comprehensive three-part plan for safe, lawful, and orderly migration across the southern border, as well as to review the Migrant Protection Protocols program. The order also directs a series of actions to restore the U.S. asylum system. Of course, there is one thing applying for asylum and quite another to win. Biden Wasting No Time Naming Officials to Reverse Trump’s Immigration Policies

CNN reports that DHS, which was largely hollowed out over the last four years, is moving with urgency to staff agencies with people who had front-row seats to the hardline immigration limits rolled out under former President Trump, in order to rescind them. Over recent days, the department has started to hire staff with extensive backgrounds in immigrants’ rights, immigration law, and refugee resettlement.

Biden Freezes Trump’s Last-Minute Visa Rules

President Biden has frozen for 60 days last-minute rules from the Trump administration that would allow only higher-wage foreign workers to be employed in the United States. Under a DHS final rule issued January 8, only the highest-paid applicants to the H-1B visa program would be selected. The DHS rule was scheduled to go into effect March 9. Another rule issued on January 14 by DOL would significantly increase H-1B holders’ minimum wages. The DOL rule was scheduled to go into effect March 15. It remains to be seen whether the Biden administration will push to rescind the recent rules after the 60-day freeze. AILA and the American Immigration Council oppose the wage-prioritization rule, noting in regulatory comments that salary does not equate with value or “fully capture an individual’s contribution to society.”

Presidential Proclamation on the Suspension of Entry as Immigrants and Nonimmigrants of Certain Additional Persons Who Pose a Risk of Transmitting Coronavirus Disease

proclamation issued today by President Biden maintaining travel restrictions on individuals from the Schengen Area, U.K., Ireland, and Brazil, as well as adding restrictions on individuals from South Africa.  Executive Order on Promoting COVID-19 Safety in Domestic and International Travel, issued on January 23, 2021, which directs the secretary of Health and Human Services, in coordination with other agencies, to assess the CDC order issued January 12, 2021, requiring a negative COVID-19 test or documentation of recovery from COVID-19 for persons entering the United States by air. CDC Publishes Order Requiring Negative COVID-19 Test or Documentation of Recovery from COVID-19 for Persons Entering by Air

The CDC published an order in the Federal Register that was initially issued by the CDC on January 12, 2021, requiring a negative pre-departure COVID-19 test or documentation of recovery from COVID-19 for all airline or other aircraft passengers arriving into the United States from any foreign country, effective January 26, 2021.

First 100 Days of the Biden Administration

On his first day in office, in addition to presenting immigration reform legislation to Congress, the president and his administration took a number of immigration-related executive actions. President Biden issued a proclamation revoking discriminatory bans on entry to the United States and an executive order revising civil immigration enforcement policies and priorities. The DHS acting secretary issued a memo directing DHS components to conduct a review of immigration enforcement policies and, beginning January 22, 2021, to pause removals of certain noncitizens ordered deported for 100 days. DHS also suspended new enrollments in the MPP program. Further, the president issued memos on preserving and fortifying the DACA program and reinstating DED for Liberians, a proclamation terminating the national emergency with respect to the U.S. southern border and redirecting funds diverted to border wall construction, and an executive order revoking prior presidential actions that excluded undocumented immigrants from the apportionment base following the decennial census.
