Biden administration appeals ruling limiting immigrant detention without court hearing.

The Biden administration filed a notice to appeal Judge Alison Nathan’s order declaring the government must arrange court hearings for immigration detainees within 10 days of their arrest. Nathan’s Nov. 30 ruling in New York was the first to put a constitutional line on how long ICE detainees had to wait for court hearings. According to government data, 84.2 percent of the initial master calendar hearings held in New York’s Varick Street immigration court came within 10 days of an ICE arrest in December. Nationally, 87 percent of these hearings were held after over 10 days of lockup. Nathan’s ruling currently only applies in New York.

Biden Wasting No Time Naming Officials to Reverse Trump’s Immigration Policies

CNN reports that DHS, which was largely hollowed out over the last four years, is moving with urgency to staff agencies with people who had front-row seats to the hardline immigration limits rolled out under former President Trump, in order to rescind them. Over recent days, the department has started to hire staff with extensive backgrounds in immigrants’ rights, immigration law, and refugee resettlement.

Presidential Proclamation on the Suspension of Entry as Immigrants and Nonimmigrants of Certain Additional Persons Who Pose a Risk of Transmitting Coronavirus Disease

proclamation issued today by President Biden maintaining travel restrictions on individuals from the Schengen Area, U.K., Ireland, and Brazil, as well as adding restrictions on individuals from South Africa.  Executive Order on Promoting COVID-19 Safety in Domestic and International Travel, issued on January 23, 2021, which directs the secretary of Health and Human Services, in coordination with other agencies, to assess the CDC order issued January 12, 2021, requiring a negative COVID-19 test or documentation of recovery from COVID-19 for persons entering the United States by air. Please note that all COVID-19-related travel bans remain in place.

Biden signs order to admit 125,000 refugees next year.

President Biden issued an executive order to increase admissions and allow the U.S. to set a goal of providing refuge to 125,000 people around the world fleeing violence, conflict and persecution. The order called for an expansion of the refugee program, which was gutted to only allowing 15,000 refugees in 2020 under the Trump administration. Biden’s order also declared that his administration would prioritize the resettlement of women, children and others facing persecution because of their gender or sexual orientation. He also instructed an interagency examination of ways to help people displaced by climate change, including by resettling them in the U.S.
