DOJ and DOL Reach Settlement Agreements with Facebook Regarding Its Use of the Permanent Labor Certification Program

The DOJ and DOL settlement agreements with Facebook regarding its use of PERM. Facebook will pay a civil penalty of $4.75 million, pay up to $9.5 million to eligible victims, and train its employees on the anti-discrimination requirements of the INA.

DOL Releases Information on H-2B Filing Timeline for Peak Filing Season

DOL’s Office of Foreign Labor Certification reminds employers and other stakeholders that the three-day filing window to submit an H-2B application requesting a work start date of October 1, 2021, will open on July 3, 2021, and close on July 5, 2021. In other H-2B news, USCIS issued a reminder that if, by July 8, 2021, fewer than 6,000 beneficiaries are requested toward the H-2B visas set aside for nationals of the Northern Triangle (Honduras, El Salvador, and Guatemala), the agency will make the unused Northern Triangle country visas available to employers regardless of the beneficiary’s country of nationality, subject to the returning worker requirement. USCIS also launched an H-2B Employer Data Hub.

DOL Change of Address

  1. DOL provided notice that the Office of Foreign Labor Certification (OFLC) National Office currently located in the Frances Perkins Building in Washington, D.C. is relocating within D.C. effective November 23, 2015. The notice includes the new contact information, but states that mail for the OFLC National Office should continue to be sent to the Frances Perkins building. A daily courier service will deliver mail to the new location.

DOL notice of a forthcoming proposed rule that would re-engineer the H-2B labor certification process to enhance transparency and strengthen program integrity and worker protections. The public may comment on the proposed rule when it is published in the Federal Register.

GAO report for new H-1B workers

GAO report finding that demand for new H-1B workers tended to exceed the cap from 2000 to 2009, and that reforms are needed to minimize the risks and costs of the H-1B program. GAO recommends that DHS and DOL work to improve the efficiency and monitoring of the program.

In an H-2A back pay/civil penalty case, the ARB found that the ALJ erred in taking administrative notice of respondent’s prior discovery abuse because the noticed facts were not generally known or verifiable. (Matter of Global Horizons Manpower, 12/21/10)
