On December 12, a federal judge issued a nationwide injunction on the rule that ended fee exemptions for many poor immigrants seeking citizenship. The previous rule allowed a fee exemption for anyone on government aid or who could show financial hardship (such as medical expenses or unemployment). The blocked rule eliminated fee waivers for government benefits and allowed waivers only to those who could show hardship or who were making no more than 150% of the federal poverty guidelines, meaning that many poor immigrants would have to pay the $725 fee. The main reason for the injunction was that the Trump administration disregarded the law when it did not seek or consider public comment on the new rule.

Military.com reports on USCIS’s announcement that the number of places overseas where noncitizen service members and their families can be naturalized will be cut from 23 to four due to the agency’s closures of international offices. Noncitizen service members will now have to apply for naturalization at four overseas military bases or “hubs,” and USCIS officers will travel to each hub every quarter to provide naturalization services.

Our client’s date of birth was incorrect on his naturalization certificate and passport and for years he unsuccessfully tried to correct this error with Immigration, the Department of State, the IRS and the Social Security Administration. When our office was retained, we filed a lawsuit against Immigration in federal court to force them to amend our client’s naturalization certificate. Within months of filing, our client received his correct certificate in the mail.

Naturalization application approved by Officer. Client was granted residency in the early 90s. He had an arrest before he got his green card (no conviction), an arrest shortly after (no conviction) and then a 2007 conviction for resisting arrest.

N-400 denied because Client supposedly did not submit certain convictions documents requested in an RFE. Client had a mail fraud and a DV conviction. However, the requested documents did not exist and the convictions were well outside the statutory period for good moral character. Nevertheless, N-400 was denied. N-336 was timely filed and USCIS issued another RFE. Documents were submitted and N-336 granted.

Client, from Pakistan, served with NTA in 2008 after applying for naturalization. Charged with a controlled substance violation and 2 CIMTs based on a grand theft conviction and a conviction for solicitation to sell cocaine. Denied charges and DHS was ordered to brief the issue. Instead, they moved to terminate without prejudice. Now we can file for Naturalization.
