The agency said it withdrew the rule prior to publication “for the purpose of reviewing issues of law, fact, and policy,” therefore not taking effect. Attorney Allen Orr, president-elect AILA, stated that he is “relieved that we are not going to have the burden of figuring out a new regulation during the heaviest season for employment immigration.”

OJ retracts ‘zero tolerance’ migrant family separation rule.

President Biden’s Justice Department formally did away with the Trump administration’s controversial “zero tolerance” border policy, which resulted in the separation of thousands of migrant families, hundreds of whom have yet to be reunited. Acting Attorney General Monty Wilkinson rescinded the policy in a memo addressed to all federal prosecutors, calling the 2018 directive “inconsistent with our principles.” Under the policy, the federal government separated families at the border so it could detain and prosecute the adults.

Mayorkas confirmed as secretary of DHS.

Alejandro Mayorkas was confirmed to serve as secretary of Homeland Security, putting him in charge of carrying out Biden’s immigration agenda and covering national security concerns. The Senate backed Mayorkas in a 56-43 vote. Mayorkas will be tasked with reuniting families separated at the southern border under the Trump administration. As part of his new duties, Mayorkas will also review the Trump-era Migrant Protection Protocols program that has forced tens of thousands people to remain in Mexico while their asylum cases are processed.

Arizona AG sues of Biden’s deportation moratorium.

AZ attorney general Mark Brnovich sued DHS on Wednesday over the Biden’s administration’s 100-day deportation pause. He stated that they sued DHS “alleging that their new policy halting deportations is illegal and it’s also contrary to an … [understanding] that we have with Homeland Security.” Arizona is the second state to sue over the deportation pause, following a similar suit brought by Texas on Jan. 22. That suit resulted in a temporary restraining order issued on Jan. 26. In response, The Biden administration argued that the agreement between the states and DHS is unenforceable because “an outgoing administration cannot contract away that power for an incoming administration.

Supreme Court cancels border wall and Remain in Mexico hearings.

the Supreme Court cancelled oral arguments in suits challenging former President Trump’s defense funding for border wall construction and a policy forcing asylum-seekers to wait in Mexico while their immigration cases proceed. The Biden administration had sought to remove the cases from the Court’s upcoming calendar, citing President Biden’s Inauguration Day orders freezing funding for the U.S.-Mexico border wall and ending enrollment in the Remain in Mexico program. Under the program, more than 68,000 migrants have been forced to wait in Mexico for decisions on their immigration cases in the U.S., according to the administration’s request. The decision to grant the Biden administration’s request came in a brief order without explanation.

Biden signs order to admit 125,000 refugees next year.

President Biden issued an executive order to increase admissions and allow the U.S. to set a goal of providing refuge to 125,000 people around the world fleeing violence, conflict and persecution. The order called for an expansion of the refugee program, which was gutted to only allowing 15,000 refugees in 2020 under the Trump administration. Biden’s order also declared that his administration would prioritize the resettlement of women, children and others facing persecution because of their gender or sexual orientation. He also instructed an interagency examination of ways to help people displaced by climate change, including by resettling them in the U.S.

ICE Defies Biden, Deports El Paso Massacre Witness, Hundreds of Others

NBC News reports that President Biden is continuing to unravel the Trump administration’s hardline immigration policies but has been unable to stop the deportation of hundreds of people, including a woman who witnessed the 2019 anti-Latino mass shooting at an El Paso, Texas, Walmart store. An early Biden executive order placing a 100-day moratorium on deportations until an enforcement review could be done was suspended by a federal judge in response to a Texas lawsuit. But the ruling didn’t require ICE to schedule deportations.
