USCIS published a final rule delaying until December 31, 2021, the effective date of its final rule creating a wage-based selection process for H-1B petitions, which was originally set to become effective March 9, 2021. On Friday, USCIS announced the FY2022 H-1B cap initial registration period will open March 9, 2021.

Thursday, a D.C. federal judge expressed concern that thousands of visa lottery winners affected by President Biden’s continued enforcement of Trump-era travel bans are in danger of losing their visas if he declines their request for immediate relief. According to a motion brought on behalf of the lottery winners, about 7,000 diversity visas issued by the State Dept. last September in response to a court order are set to expire, as they are valid for a maximum of six months. Attorneys for the lottery winners argue that time is of the essence, and emergency relief is the only way to ensure that their visas will be safe until Biden rescinds the bans. The judge said he will issue a decision “quickly.”

The Department of Labor finalized changes to the H-2A agricultural visa program on Friday to replace prevailing wage guidelines and permit businesses to stagger the entry of workers into the U.S. The final rule’s changes include requirements that employers electronically file key documents to apply for the H-2A program and provisions allowing small businesses that offer part-time work to jointly file a single H-2A application and employ the same workers full-time. The rule also allows government officials to inspect employer-provided housing, which is mandatory under the program, for up to 24 months and order improved living conditions. The rule will go into effect 30 days after it is published in the Federal Register.

Another win for the Law Offices of Brian D. Lerner, APC: Green card holder father petitioned on clt’s behalf while she was a single child, but she was married by the time she entered. So CIS denied clt’s N-600 b/c there are no visas for married children of LPR’s. But this was a mistake since clt’s father petitioned, then he naturalized, then clt got married, and then she entered. So when clt was in removal proceedings, DHS agreed that clt was eligible and that clt’s visa category changed from 2nd preference visa category to 3rd preference visa category at entry. Proceedings were terminated.
