On April 15, 2015, the federal district court for the Northern District of Florida issued an order effectively permitting DOL to continue issuing H-2B labor certifications under its 2008 H-2B regulations through May 15, 2015.

USCIS announced that it has received enough petitions as of March 26, 2015, to reach the H-2B cap for FY2015. As such, USCIS will reject any new H-2B petitions that request a start date before October 1, 2015, and were received after March 26, 2015.

USCIS announced that it has received a sufficient number of petitions to reach the congressionally mandated H-2B cap for the first half of FY2014. The final receipt date for new H-2B worker petitions requesting an employment start date before April 1, 2014 was March 14, 2014.

H-2B cap almost reached. As of January 24, 2014, USCIS receipted 25,477 beneficiaries toward the 33,000 H-2B cap for the first half of FY2014. This count includes 19,253 approved and 6,224 pending beneficiaries. Information for the second half of the FY2014 H-2B cap is also included.

As of 1/13/12, USCIS receipted 22,817 petitions toward the 33,000 H-2B cap amount for FY2012. This count includes 16,571 approved and 6,246 pending petitions. The FY2012 H-2B cap count also includes information for second half of FY2012.

BALCA Excuses Noncompliance with §655.10(a)(2) Due to H-2B PWD Delay

BALCA vacated the denial where the employer made every effort to comply with §655.10(a)(2) but was simply unable to file its application in time for its season as a result of the NPWC’s delay in issuing the PWD.

DOL Delays Revision of the Wage Methodology for the H-2B Program

DOL press release announcing that it will postpone the effective date of the H-2B wage methodology final rule for a period of 60 days, from 9/30/11 to 11/30/11. The postponement is intended to avoid administering the H-2B program under potentially conflicting court orders.
