Matter of TIMA, 26 I&N Dec. 839 (BIA 2016)
A fraud waiver under section 237(a)(1)(H) of the Immigration and Nationality Act, 8 U.S.C. § 1227(a)(1)(H) (2012), cannot waive an alien’s removability under section 237(a)(2)(A)(i) for having been convicted of a crime involving moral turpitude, even if the conviction is based on the underlying fraud.

Fraud waiver approved for Client who used fake identity documents to obtain residency in the United Kingdom and then used the same documents when he was petitioned by his U.S. citizen wife. Client can now reenter the United States and join his wife who serves in the U.S. Navy.
