DHS officials formally banned separating children from parents who are caught illegally crossing U.S. border, as part of an effort by the Biden administration to revert the effects of Trump’s “zero tolerance” policy. CBP Acting Commissioner Troy Miller issued a memo to the heads of Border Patrol and CBP’s Office of Field Operations prohibiting the separation of children from their parents or guardians for convictions on illegal entry to the U.S., and banning the referral of parents for prosecution exclusively on the grounds of illegal entry to the country. Miller’s memo added an exception on national security grounds, allowing CBP and Border Patrol agents to refer illegal entry for prosecution with approval of higher-ranking officials and local counsel.

DHS announced that ICE has rescinded two delegation orders related to the collection of civil financial penalties for noncitizens who fail to depart the U.S. ICE had initiated enforcement of civil penalties in 2018, but as of January 20, 2021, ICE ceased issuing these fines. The rescission marks ICE’s latest move toward focusing its limited resources on those posing the greatest risk to national security and public safety in accordance with the current guidance on civil immigration enforcement and removal priorities, which were issued on Feb. 18, 2021.

DHS Secretary Mayorkas announced that a handful of migrant families that were separated at the border by the Trump administration will be allowed to reunify in the U.S. this week. The four families will be the first to be reunified through a task force that was created by President Biden shortly after taking office in January. The families came from Honduras and Mexico, and some had been separated as far back as 2017. The executive director of the family reunification task force, longtime human rights advocate Michelle Brané, said the parents would be given temporary permission to enter the U.S. through a process known as humanitarian parole. Immigrant advocates welcomed the announcement, but expressed frustration at the slow pace of reunification.

DHS is proposing to amend its F-1 nonimmigrant student visa regulations on optional practical training (OPT) to allow certain F-1 STEM students who have elected to pursue 12 months of OPT in the United States to extend the OPT period by 24 months. An advance copy of the proposed rule is now available. The proposed rule is scheduled to be published in the Federal Register on October 19, 2015, and comments will be due 30 days after its publication. On August 12, 2015, the District Court for the District of Columbia vacated the2008 STEM OPT extension rule, but stayed the vacatur until February 12, 2016, to allow DHS the opportunity to reissue the rule with proper notice and comment

In a status update on its border security efforts, DHS indicated that the number of total apprehensions along the southwest border during the first six months of FY2015 was 151,805, which is down nearly 60,000 (or 28%) compared to the same period in FY2014. Additionally, total apprehensions along the southwest border—comprised of apprehensions of unaccompanied children, family units, and single adults—for FY2015 are at their lowest point in the past four fiscal years.

Last week, the Senate passed a DHS appropriations measure that did not include the House amendments that would block DAPA implementation and DACA expansion by a vote of 68-31. Today, in a surprising move, Speaker Boehner allowed for the Senate-passed version of the DHS funding bill to be voted on in the House. The bill passed with bipartisan support in the House, 257-167 (with 75 Republicans joining 182 Democrats), and will now be sent to President Obama’s desk for his signature. The bill will fund DHS through September 2015. The bill that passed does not include language that would prohibit the implementation of the President’s November 2014 executive actions on immigration.

DHS released enforcement statistics for FY2014, which include reports from ICE and CBP. In FY2014, ICE removed or returned 315,943 individuals, 213,719 of whom were apprehended while, or shortly after, attempting to illegally enter the U.S., and 102,224 of whom were apprehended in the interior of the U.S. CBP made 486,651 apprehensions in FY2014, compared to 420,789 in FY2013. Both apprehension and removal numbers were influenced by the 68% increase in individuals migrating from countries other than Mexico, predominately from Central America.
