DOS Posts Visa Bulletin for February 2021

DOS posted the February 2021 Visa Bulletin. In addition to final action dates and dates for filing for family and employment-based petitions, it contains notes on the diversity visa (DV) category, DV category rank cutoffs that will apply in March, visa availability in the coming months, an annual report of immigrant visa applicants in the family-sponsored and employment-based preferences registered at the National Visa Center as of November 1, 2020, and more. USCIS determined that, for February 2021, F2A applicants may file using the Final Action Dates chart. Applicants in all other family-sponsored preference categories must use the Dates for Filing chart. Applicants in all employment-based preference categories must use the Final Action Dates chart.

DOS Provides FY2021 Annual Numerical Limits

DOS provided charts with the FY2021 annual numerical limits for both family and employment-based visa preference categories. Also, in case you missed it, DOS posted the January 2021 Visa Bulletin and USCIS posted the related Adjustment of Status charts. For the first time this fiscal year, USCIS has stated that all employment-based adjustment of status applications must be filed based on the Final Action Dates chart. The Dates for Filing chart may be used for all family-sponsored applications, except that F2A applicants may file adjustment of status applications using the Final Action Dates chart.

Visa Bulletin and Adjustment of Status Dates for March 2019

DOS posted the Visa Bulletin for March 2019. In addition to the final action dates and dates for filing applications, the bulletin includes notes about diversity immigrant visas (DV), the Employment Fourth Preference Category for Certain Religious Workers (SR), and the Employment Fifth Preference Categories (I5 and R5). USCIS determined that for March 2019, the Dates for Filing chart must be used for family-based preference filings and the Final Action Dates chart must be used for employment-based preference filings.

Not sure when to file for Adjustment?

USCIS posted an announcement on its website informing adjustment of status applicants that they must use the “Application Final Action Dates” chart in the DOS Visa Bulletin for December 2015 for employment-based filings. USCIS stated that family-sponsored adjustment of status applicants may use the “Dates for Filing Visa Applications” chart in the December 2015 Visa Bulletin.
