Census Bureau Stops Work on Trump’s Request for Unauthorized Immigrant Count

NPR reports that the U.S. Census Bureau has halted all work on President Trump’s directive to produce a state-by-state count of unauthorized immigrants, which the president planned to use to alter a key set of census numbers that will be used to reallocate each state’s share of congressional seats and Electoral College votes for the next decade. Three lower courts found the president’s memo unlawful, unconstitutional, or both before the Supreme Court ruled in December that it was too early for any court to weigh in because the case is “riddled with contingencies and speculation.

Supreme Court to take up census battle

Months ago, President Trump announced he would order the Commerce Department to exclude undocumented immigrants from census reporting, which is used to determine state’s seats in the House of Representatives. Nearly half the states, including several cities and counties, filed suit and compared his move to slavery-era rules that limited which “persons” were counted for political purposes. Nearly 30 amicus briefs were filed on the issues. The Supreme Court took up the case in October, and is scheduled to hear oral argument

New York has made it a felony to share DMV data with immigration enforcement agencies

 New York’s Green Light Law allows undocumented immigrants to apply for driver’s licenses. It also bars law enforcement from sharing driver data with ICE or DHS. In April, New York made a change to that law, making the violation of that law a felony. This could have a large impact on ICE, which relies heavily on collaboration from state and local law enforcement.

A new law was passed in the city of Cambridge to advise police to issue summons to unlicensed drivers instead of arresting them. This was existing procedure, but is now codified into law. This is a way to shield undocumented immigrants from immediate immigration consequences- if they are arrested for even a minor violation, they could be flagged by ICE. Massachusetts does not current allow undocumented immigrants to receive driver’s licenses.

A border activist was acquitted of harboring undocumented immigrants in Arizona.

Two Central American men were staying at a camp run by a humanitarian group in Arizona. This lead to the arrest of Scott Warren, the activist running the camp, for allegedly illegally harboring immigrants. After a long battle in court, including a mistrial last year, he was acquitted on Wednesday. The prosecutor argued that Warren was helping the men hide from authorities, while Warren argued that his humanitarian work aims to keep people from dying in the desert, and he was “orienting” the men before they went on their way. In the end, the jury came out in Warren’s favor. After the verdict, the U.S. attorney said that the government would continue to prosecute those who harbor immigrants, whether for money or “a misguided sense of social justice.”
