We Build the Wall is a private group supporting the president and his building of the barrier along the U.S.-Mexico border. The group raised money to build a small section of private border wall. The National Butterfly Center, located near the planned wall, sued to stop its construction. On Tuesday, a Texas judge issued a preliminary injunction, blocking construction. In the order, Judge Keno Vasquez said that building the barrier could cause “imminent and irreparable harm” to the 100-acre wild butterfly habitat. The founder of We Build the Wall said he had not heard anything about the order, and that it was “more fake news.”

The Trump administration is planning on using eminent domain to acquire private land in Texas to use for the border wall. On Thursday, the government sent Right of Entry letters to dozens of landowners informing them that it will be surveying the land. The owners must sign the letters for the government to be able to come onto the land, but if they don’t sign, the matter will be escalated to the DOJ to get court-ordered access. Acting CBP Commissioner Morgan stated that he is aware there will likely be litigation over the land acquisition, but thinks that the government is “on track” to get the 450 miles for the wall.

On Thursday, the House blocked the White House plan to divert $700 billion in Pentagon funding to build the border wall. The filibuster and vote was mostly along party lines, with Democrats criticizing the attempted transfer of money from health and education to the border wall. This was the second time in six weeks that the House has blocked the measure.

The Associated Press reports that House Democrats will file a resolution tomorrow aimed at blocking the national emergency declaration that President Trump issued to help finance a wall along the southwest border. According to The Hill, Republican Senator Susan Collins of Maine is “strongly opposed” to the president’s declaration and supports the lawsuit filed by 16 states challenging the emergency declaration. Sen. Collins said she wouldn’t be surprised “if the courts find the president’s action is contrary to the separation of powers.”

The Hill reports that a coalition of civil liberties and immigration groups have raised concerns with congressional leadership about border technologies proposed as part of the bipartisan and bicameral negotiations to reach a border deal by February 15 to avoid another shutdown. According to the groups, surveillance drones, license plate readers, and DNA testing could raise serious privacy concerns for those crossing the border and living in border cities, while “risk-based targeting” and biometrics technologies could result in racial profiling and harm vulnerable communities.

The Associated Press reports that the House of Representatives has passed a $788 billion spending bill that combines a $1.6 billion down payment for President Trump’s controversial border wall with a huge budget increase for the Pentagon. Significant hurdles remain in front of the measure, which will encounter more powerful Democratic opposition in the Senate. In addition, a potential government shutdown battle over the border wall looms this fall, and the increase in defense spending runs afoul of strict spending limits set by an earlier budget law.
