USCIS announced flexibilities for F-1 students affected by delayed Form I-765 receipt notices. These flexibilities, including 14-month OPT period flexibilities, option to refile after rejection, and RFEs for missing/deficient signatures, apply only to applications received from October 1, 2020, to May 1, 2021.

The DOL Office of Foreign Labor Certification (OFLC) issued guidance regarding California wildfires, stating that extensions will be granted for issues that arise from disaster-related conditions, including delays caused as a result of the disaster.

USCIS recently published a final rule amending 8 CFR §274a.12(b)(20) to authorize continued employment for up to 240 days for H-1B1 (Chile, Singapore), E-3 (Australia) and CW-1 (Commonwealth of the Northern Mariana Islands) nonimmigrants whose status has expired, provided that the employer filed a timely extension of stay with USCIS. The amended regulation took effect on February 16, 2016
