USCIS Updates Process to Reschedule Biometric Services Appointments

USCIS announced that applicants, petitioners, requestors, and beneficiaries may now call the USCIS Contact Center (800-375-5283) to reschedule their biometric services appointments scheduled at a USCIS ASC. Previously, applicants had to submit requests in writing to reschedule biometrics appointments.

USCIS Temporarily Suspends Biometrics Requirement for Certain Form I-539 Applicants

USCIS announced that, effective Monday, May 17, 2021, it will temporarily suspend the biometrics submission requirement for certain applicants filing Form I-539 to request an extension of stay in, or change of status to, H-4, L-2, and E nonimmigrant status. The suspension will apply through May 17, 2023. BIA Issues good case

Matter of D-M-C-P, 26 I&N Dec. 644 (BIA 2015)

(1) Neither an Immigration Judge nor the Board of Immigration Appeals has jurisdiction to consider whether asylum-only proceedings were improvidently instituted pursuant to a referral under the Visa Waiver Program.

(2) It is improper to deem an application for relief abandoned based on the applicant’s failure to comply with the biometrics filing requirement where the record does not reflect that the applicant received notification advisories concerning that requirement, was given a deadline for submitting the biometrics, and was advised of the consequences of his or her failure to comply.
