TPS applicants from five designated countries can now file initial applications online

USCIS announced that TPS applicants who are eligible nationals of Burma, Somalia, Syria, Venezuela or Yemen can now file Form I-821, Application for Temporary Protected Status, online, if they are applying for TPS for the first time. USCIS is starting with these countries because they are either new designations or recently announced re-designations. All other TPS applicants and current beneficiaries who are re-registering under the extension of a TPS designation must continue to file a paper Form I-821.

Supreme Court Rules Against Immigrants with Temporary Status

The unanimous decision issued yesterday by the U.S. Supreme Court holding that Temporary Protected Status (TPS) recipients who entered the United States unlawfully are not eligible under §1255 for lawful permanent resident status merely by dint of their TPS. AILA Board member Andrew Nietor explains, “It’s important to realize that this is not going to affect everybody who has TPS, but it will affect many who are otherwise eligible to become legal, permanent residents.”

Temporary Protected Status recipient is deemed to be in a lawful status as a nonimmigrant

Affirming the district court’s summary judgment in favor of the appellee, the Ninth Circuit held that under INA §244(f)(4), a Temporary Protected Status (TPS) recipient is deemed to be in lawful status as a nonimmigrant—and has thereby satisfied the requirements for becoming a nonimmigrant, including inspection and admission—for purposes of adjustment of status under INA §245(a). The court thus found that the plaintiff-appellee, a TPS beneficiary, was eligible to obtain lawful permanent residence

From El Salvador and did not receive your TPS?

USCIS updated its El Salvador Temporary Protected Status (TPS) webpage with a note indicating that, as of late September 2015, USCIS had approximately 6,000 El Salvador TPS renewal cases that remain pending and have not received a new employment authorization document (EAD) to replace the one that expired on September 9, 2015. On October 5, USCIS began the process of issuing interim EADs with a 180-day validity period for these cases. USCIS expects to issue final EADs by the end of December 2015.

The Department of Homeland Security (DHS) issued a notice that the Republic of Yemen has been designated for Temporary Protected Status (TPS) for a period of 18 months, effective today through March 3, 2017, due to an ongoing armed conflict within the country.
