Affirming the district court’s summary judgment in favor of the appellee, the Ninth Circuit held that under INA §244(f)(4), a Temporary Protected Status (TPS) recipient is deemed to be in lawful status as a nonimmigrant—and has thereby satisfied the requirements for becoming a nonimmigrant, including inspection and admission—for purposes of adjustment of status under INA §245(a). The court thus found that the plaintiff-appellee, a TPS beneficiary, was eligible to obtain lawful permanent residence

TPS for Nepal Extended for 18 Months

DHS extended Temporary Protected Status (TPS) for eligible nationals of Nepal (and those without nationality who last habitually resided in Nepal) for an additional 18 months, effectiveDecember 25, 2016, through June 24, 2018. The 60-day re-registration period runs throughDecember 27, 2016. This extension also allows TPS re-registrants to apply for a new Employment Authorization Document (EAD) with an expiration date of June 24, 2018. USCIS is automatically extending current TPS Nepal EADs with a December 24, 2016, expiration date for six months.

From El Salvador and did not receive your TPS?

USCIS updated its El Salvador Temporary Protected Status (TPS) webpage with a note indicating that, as of late September 2015, USCIS had approximately 6,000 El Salvador TPS renewal cases that remain pending and have not received a new employment authorization document (EAD) to replace the one that expired on September 9, 2015. On October 5, USCIS began the process of issuing interim EADs with a 180-day validity period for these cases. USCIS expects to issue final EADs by the end of December 2015.

The Department of Homeland Security (DHS) issued a notice that the Republic of Yemen has been designated for Temporary Protected Status (TPS) for a period of 18 months, effective today through March 3, 2017, due to an ongoing armed conflict within the country. This designation allows eligible Yemeni nationals (and immigrants having no nationality who last habitually resided in Yemen) who have continuously resided in and been continuously physically present in the United States since September 3, 2015, to be granted TPS. The 180-day registration period ends on March 1, 2016.

This designation allows eligible Nepalese nationals (and immigrants having no nationality who last habitually resided in Nepal) who have continuously resided and have been continuously physically present in the United States since June 24, 2015, to be granted TPS. The 180-day registration period ends on December 21, 2015.

DHS extended the designation of Somalia for Temporary Protected Status (TPS) for 18 months from September 18, 2015, through March 17, 2017. The 60-day re-registration period runs from June 1, 2015, through July 31, 2015.
