ICE Review of Immigrant’s Suicide Finds Falsified Documents, Neglect, and Improper Confinement

Intercept is reporting on the results of an internal review of a recent suicide that took place in ICE detention. The review found that staff falsified documents, improperly dealt with the victim’s medication, neglected to follow proper procedures for his care, and improperly placed him in disciplinary solitary confinement — despite multiple warnings of his declining mental health. https://www.ice.gov/

9th Circ. says judges can reopen deported immigrant cases.

The Ninth Circuit held that immigration judges can reopen the cases of immigrants who have been removed from the U.S. or who voluntarily left. In its decision, the panel sided with a Mexican native who was removed in 1995 and asked an immigration judge to reopen his case sua sponte after he returned to the U.S. so he could apply for adjustment of status. The judge refused – and the BIA agreed – finding that a judge is blocked from taking sua sponte action because the migrant had left the country. However, the panel said that the departure bar does not apply to a sua sponte reopening of a case, but only limits motions to reopen. The panel has now joined a Circuit split on the issue, siding with the Tenth Circuit, and differing from the Second, Third, and Fifth Circuits.

Confusion of the new public charge rule has had a chilling effect on immigrants

Attorneys for Cabrini Immigration Services reported a lot of confusion about the soon-to-be-enacted public charge rule. Many are unclear on who is affected by the rule, think it applies retroactively, and are also unsure what social services are trigger the rule. This confusion has led some immigrants and prospective immigrants to avoid public assistance or medical care. The rule goes into effect on February 24.

U.S. News and World Report: Supreme Court to Consider Indefinite Detention for Immigrants

This U.S. News and World Report article reports that the U.S. Supreme Court will hear arguments on Wednesday over whether immigrants facing deportation can be detained indefinitely for months or even years without a hearing. The case, Jennings v. Rodriguez, could have broad implications for President-elect Donald Trump’s proposals to step up immigration enforcement and ramp up deportations. If the respondents prevail, the Supreme Court could require mandatory bond hearings for detained immigrants nationwide. If the government wins, however, tens of thousands of people could be exposed to potentially indefinite periods of immigration detention.
