U.S. Border Patrol head removed

The Biden administration has removed Rodney Scott from his position as the head of U.S. Border Patrol. On Wednesday, Scott posted a statement on social media saying he was sent a letter offering him the choice to resign, retire or relocate. He said the notice didn’t give a reason for his removal, but claimed it was done “so the new administration can place the person they want in the position.” Scott will remain in his role for the next 60 days but did not decide if he will leave the Border Patrol or accept a reassignment. According to DHS, deputy chief Raul Ortiz will replace him as the interim head.

U.S. closes Trump-era office for victims of immigrant crime.

Biden administration announced it has dismantled a Trump-era government office to help victims of crimes committed by immigrants. Trump created the Victim Of Immigration Crime Engagement Office (VOICE) by executive order during his first week in office in January 2017 in an effort to link immigrants to crime. ICE said it was replacing VOICE with a “more comprehensive and inclusive victim support system” called The Victims Engagement and Services Line.

Biden administration official ends ‘Remain in Mexico’ asylum policy

The BIA ruled that a mere continuation of an activity in the United States that is substantially similar to the activity from which an initial claim of past persecution is alleged cannot establish changed circumstances under INA §208(a)(2)(D).

DHS formally bans separations for illicit border crossings.

DHS officials formally banned separating children from parents who are caught illegally crossing U.S. border, as part of an effort by the Biden administration to revert the effects of Trump’s “zero tolerance” policy. CBP Acting Commissioner Troy Miller issued a memo to the heads of Border Patrol and CBP’s Office of Field Operations prohibiting the separation of children from their parents or guardians for convictions on illegal entry to the U.S., and banning the referral of parents for prosecution exclusively on the grounds of illegal entry to the country. Miller’s memo added an exception on national security grounds, allowing CBP and Border Patrol agents to refer illegal entry for prosecution with approval of higher-ranking officials and local counsel.

4th Circuit says Immigration Judges must Develop Record.

The Fourth Circuit ruled that immigration judges have a legal duty to fully develop the record in cases before them, adding that this mandate is particularly important for immigrants appearing in their court without an attorney. The court noted that the INA’s mandate that immigration judges “administer oaths, receive evidence, interrogate, examine and cross-examine” noncitizens amounts to a statutory obligation to develop the record. The decision – now precedent in the Fourth Circuit – joins several other circuits that also held that immigration judges have the legal duty to fully develop the record. While other courts have read the INA as also mandating this duty, there is still a circuit spilt among the appellate courts for when this duty comes into play.

Biden’s USCIS nominee sets goals for agency solvency and backlogs.

President Biden’s nominee to lead USCIS, Ur Jaddou, has set fiscal solvency, reduced backlogs, and a technological upgrade to the top of her list of goals for the agency. In addition, Jaddou will work to ensure that USCIS staff “have the resources, support, and leadership they need to carry out their roles,” she told the Senate Judiciary Committee during a hearing Wednesday. Before joining USCIS as chief counsel, she worked on immigration policy for Rep. Lofgren (D-CA), who chairs the House Judiciary’s immigration subcommittee, and as deputy assistant secretary for regional, global, and functional affairs in the State Dept’s Bureau of Legislative Affairs.

Biden revokes healthcare insurance proclamation.

President Biden revoked Presidential Proclamation 9945 of October 4, 2019, which suspended the entry of immigrants who would financially burden the U.S. healthcare system. In his proclamation, Biden noted that the Proclamation “does not advance the interests” of the U.S. The revocation also noted that the 2019 Proclamation is “in tension” with the Biden administration’s newer, migrant-friendly agenda issued Executive Order from February 2, 2021, called Restoring Faith in Our Legal Immigration Systems and Strengthening Integration and Inclusion Efforts for New Americans.

Biden to soon admit 250 ‘vulnerable’ migrants into the U.S. daily

A DHS spokesperson confirmed that the Biden administration will soon allow up to 250 “particularly vulnerable” immigrants into the U.S. each day. This is an exception to the current policy that blocks most families and single adult migrants from crossing the U.S.-Mexico border. Already, CBP has allowed roughly 2,000 vulnerable immigrants to enter the U.S. as they await their immigration hearings, according to the ACLU, which is challenging the administration in court to give all migrants that right. Immigrants considered particularly vulnerable include those who are ill, families with very young children or immigrants who have been threatened or attacked while they wait in Mexico.

USCIS to allow rescheduling of biometric services appointments by phone.

USCIS announced that applicants, petitioners, requestors and beneficiaries may now call the USCIS Contact Center to reschedule their biometric services appointments. Previously, applicants had to submit requests in writing to reschedule their biometrics appointments. The change helps eliminate undue paperwork and allows the agency to track the request through a more efficient process. Applicants must establish good cause for rescheduling and must call before the date and time of their original appointment to reschedule. If an applicant fails to call before the scheduled appointment or fails to establish good cause, USCIS may consider the application, petition, or request abandoned and, as a result, it may be denied.
