My permanent resident literacy student, Maria Espinoza, just received Form-797C rejecting her request for waiver of the $680 Naturalization fee she requested via Form I-912. The Application is #NBC*0022589789. The reason given is she did not meet the poverty level for a family of her size – just she & her husband.
Entry at Line 11 is “$1,364/month x 10 months” which is the average of the available work receipts of 2011. Entry at Line 13 reported that her husband does not work all year and only works 10 months out of the year.
Is it possible that the staff multiplied the $1,364 x 12 = $16,368 when their annual income averages $1,364 x 10 is only $13,640 ? At the time of preparing the forms, we were advised that the poverty level was about $15,??? which would be if the staff had realized he doesn’t work all 12 months, hence his annual income is below the poverty level.
I realize the poverty level can fluctuate, so maybe it is now lower than their annual income of $13,640. Could you please advise the current poverty level? And if this analysis makes sense, what can I do to get the application reassessed ? Your advice & counsel will be appreciated. Thanks!
