DHS issued a statement noting that Secretary Mayorkas has ratified a rule that removes the 30-day EAD processing requirement for asylum applicants. This ratification covers only the timeline repeal and not the broader rule restricting asylum EAD eligibility. It does not affect the preliminary injunction in CASA v. Wolf (now Mayorkas).

Over the weekend, DHS Secretary Mayorkas fired most of the members of the Homeland Security Advisory Council (HSAC). The HSAC is made up of 30 members – both Democrats and Republicans. Mayorkas stated that he ended the current HSAC term to “service…an orderly transition to a new model” and that he “will reconstitute HSAC in the next few weeks.” The HSAC produces reports and advises the secretary on a range of issues from domestic violent extremism to biometrics. Among those fired were allies of former President Trump, including former DHS Secretary Ken Cuccinelli and former ICE Director Thomas Homan.

The New Yorker reports on the “extensive, unpublicized bureaucratic effort to transform immigration through rule changes, adjustments to asylum officers’ guidelines, modifications to enforcement norms, and other measures” that took place during the Trump administration, as well as the real-life impact these policies have had on people fleeing violence and persecution and seeking to immigrate to the United States. The article also covers what it will take for the Biden administration to undo these measures. Politico reports that the Senate has delayed its vote to confirm Alejandro Mayorkas, President Biden’s nominee to lead DHS, to tomorrow due to inclement weather.

Alejandro Mayorkas was confirmed to serve as secretary of Homeland Security, putting him in charge of carrying out Biden’s immigration agenda and covering national security concerns. The Senate backed Mayorkas in a 56-43 vote. Mayorkas will be tasked with reuniting families separated at the southern border under the Trump administration. As part of his new duties, Mayorkas will also review the Trump-era Migrant Protection Protocols program that has forced tens of thousands people to remain in Mexico while their asylum cases are processed.

Yahoo News reports on President-Elect Biden’s announcement that he intends to nominate Alejandro Mayorkas as secretary of DHS. Mayorkas, who previously served as deputy secretary of DHS under President Obama, is the son of Cuban Jews who came to the United States as refugees in 1960, less than a year after he was born.
