Fifth Circuit Extends Stay on Preliminary Injunction on Biden Enforcement Memos Indefinitely

On Friday, August 27, the Fifth Circuit Court of Appeals extended the district court stay on the preliminary injunction on the Biden immigration enforcement memos indefinitely.

Texas court expected to rule on constitutionality of DACA in near future.

A federal judge in Texas is expected to rule within days – to a few weeks – on a case that will determine the fate of DACA and 640,000 immigrants brought to the country as children illegally. While the Biden administration has vowed to secure a pathway for citizenship for these people, many anticipate that DACA will be ruled unlawful, resulting in recipients being stripped of their protection from deportation and work permits. Texas and eight other states are asking the court to end DACA, arguing the program is unconstitutional. The first hearing was in December, but the judge did not issue an immediate ruling.

BIA Finds Subsequent NTA Perfects Deficient NTA and Ends Accrual of Physical Presence for Purposes of Voluntary Departure

the BIA ruled that if an NTA fails to specify the time/place of an initial removal hearing, a subsequent NTA with the information perfects the deficient NTA and ends the accrual of physical presence for purposes of voluntary departure. Additionally, last week, the BIA ruled that §58-37-8(2)(a)(i) of the Utah Code, which criminalizes possession of a controlled substance, is divisible with respect to the specific “controlled substance” involved in a violation of that statute.
