The Arizona Law is a disgrace to the U.S. Articles are being written about this in many forums. The Arizona Law is unconstitutional and should be struck down. As an Immigration Attorney, I wonder what would make the Governor of Arizona decide to sign such racist legislation into law. There are even other political candidates saying they will pass a similar Bill if elected. It is a shame that it seems the only reason these other candidates will support such a law is to get the racist vote.

  1. Arizona SB1070 is not racist. It assists the federal government’s enforcement of it’s own immigration law. Since federal immigration law is not racist, SB1070 cannot possibly be racist.

    Further, the accusation of racism cannot be applied simply because one race will be affected more than other races. Otherwise, immigration reform is racist because it will benefit one race more than other races. If government action is racist merely because it affects a specific race(s) disproportionally to another race(s), then affirmative action, counterterrorism, and tax breaks for the working class are racist actions.

  3. You last comment shows exactly why they had to write a state law so that they could enforce it. There are federal and state drug laws, why not federal and state immigration laws. There are in fact other states with tough immigration laws already. This law suit is redundant and just a stunt to get Latino votes.

The title, picture and comment would seem to lead one to believe that you are in agreement with the disgraceful racial law in Arizona. However, the reality is exactly the opposite. If you were so proud of your position, why would you have to hide it and misrepresent the nature of it in the first place?

  5. You are incorrect. State police do not enforce federal drug laws. They enforce State drug laws. There are no ‘State’ Immigration Laws to enforce. Therefore, if they are attempting to enforce Immigration Laws, it will be Federal.

  7. What about local State police enforcing various other federal laws having to do with drugs and violence? States are constantly enforcing federal law and what would you have to say about sanctuary cities. Those cities are in direct opposition to federal immigration policy, but yet have not been sued by the federal government.

  8. I must agree with you emuleman.
    Arizon is only trying to protect its populace. They have seen a rise in crime due to these illegal immigration and smuggling tactics. One way to deal with this is to use an vague Federal Law and taylor it to the states need. Gov. Jan Brewer is doing the right thing in absence of genuine leadership, which is apparent our current administration severely lacks.
    It is true the Federal Government needs and overhaul, a very strict and almost micromanagement of immigration policies and procedures to rapidly decrease the illigal immigration and relieve the local governments of the burden.
    Honestly the local governments police, city or state, are doing there job by cracking down on crimes wheather a misdeamenor or felony. It is a misdeamenor to illegally cross into the US according to AZ. Well I guess that means police are just apprehending criminals, which is their job! It is their job to uphold the law, city, state, or federal!
    Yes I will admit Mr. Lerner that I have all intentions, if being elected to develop and administor the strictest of immigration laws. Sue me, I am a Patriot and American, if someone wants to enjoy what i may have, they can enter the US the correct way.
    My Grandmother was an immigrant from Russia, she did it the right way. Why can’t anyone else? Why should we make it easy for them. Hell no, it takes sacrifice to live the American. Money and Time, those fortuanate become Americans, those not, can watch from the fence. I would shut every border down, until we get a grasp of this illigal immigration situation.
    Americans, especially on the border deserved to be protected and if you will break an American Law to become an American, or just bask in our way of life, then what other crimes would you commit? I won’t chance that.
    What sad is the AZ Immigration Law is Law, there is no changing it now and Gov Brewer wont back down.

  9. I agree, we do need a comprehensive overhaul of the immigration system. I guess the citizens of Arizona should sit patiently and wait for this to happen?

    The US government has been talking about an overhaul for decades, and as usual nothing gets done. In the mean time the poor citizens are under seize in Arizona, and have decided to try something to help them with this huge problem. Around 70% of Arizona’s citizens agree with the law. Why? Because they have seen how ineffective the federal government has been in not only dealing with this issue, but with dealing with providing a new fair immigration system to protect the citizens of Arizona.

    They are only trying to enforce the existing federal laws already on the books, and I don’t blame them for trying.

    Hopefully this will finally bring this issue to the forefront, and force the federal government to work on a fair and practical overhaul of the immigration system.

  10. Your first sentence shows a major problem with the law. You state that the Arizona law simply enforces existing ‘federal’ laws. It is not supposed to be within the jurisdiction of local State police to enforce the Federal Laws. That is within the ambit of the Federal Government and its agencies. This law oversteps its constitutional bounds. Having local police enforce federal laws is not going make the system ‘work’. What will work is a comprehensive overhaul of the immigration system.

  11. * The Arizona law simply enforces existing federal laws. Now Arizona police can actually enforce laws that are already on the books. Obviously the reason for this is because the federal government is not enforcing the law effectively in Arizona. The new Arizona law simply states that violating federal immigration law is now a state crime as well. Because illegal immigrants are by definition in violation of federal immigration laws, they can now be arrested by local law enforcement in Arizona. No new actions. No new powers. No new nothing. Simply enforcing federal law, and absolutely nothing else.

    * The law only allows police to ask about immigration status in the normal course of “lawful contact” with a person, such as a traffic stop or if they have committed a crime. Before asking a person about immigration status, law enforcement officials are required by the law to have “reasonable suspicion” that a person is an illegal immigrant. The concept of “reasonable suspicion” is well established by court rulings. Since Arizona does not issue driver’s licenses to illegal immigrants, having a valid license creates a presumption of legal status. The same thing happens to me when I get pulled over, they ask to see my drivers license or identification card. This is not a new, radical concept or law. Police have been asking people for identification for many years.

    * The law prevents employers from hiring illegals, and prevents people from being hired as day labor off the street. This again is only allowing Arizona to enforce the federal law.
